In a non-marital union, the presumption is that moms have custody rights. What do you do, if you have an ex-spouse who is trying to take a baby and leave town? There is a presumption that both parties have a right to come before the court. Both can seek custody and their joint environment. If you are an unmarried parent and your ex-partner takes your baby and leaves town, you should:
*Stay calm and do not flee. Leaving town will only make things more difficult for you in the long run. *Call the police. Your ex-partner may be aggressive, violent, or threatening. You should call the police immediately. *Contact a lawyer. A lawyer can help you file a court order to establish custody of your child. *Go to court. Once you have filed a court order, the court will hold a hearing to determine who should have custody of your child.
It's important to keep in mind that you're not by yourself. Unmarried parents can get help from a variety of sources. Ask for help from nonprofit groups and family law professionals. You're a single parent and your ex takes your child. Then your ex-spouse flees. It is critical to know your legal options and how to pursue them.
