Does cheating matter in a divorce? When does infidelity become a relevant factor in a divorce? Michigan is a no-fault divorce state. It means any person can seek divorce without demonstrating fault. Such a statement on its face says cheating doesn't matter. Why would it? In a no-fault divorce, we don't have to point fingers at who is at fault. In getting a divorce, cheating doesn't matter. Does cheating matter for other things? The answer is, yes it does. It could matter in property division. It matters in the determination of custody of minor children. You have to consult an attorney to find out the relevant factor involved. Cheating may not contribute to getting your divorce. It can make negotiation harder. You may have to persuade the court that cheating caused the breakdown of the marriage. That can make cheating relevant.
