If you were assaulted and did not press charges at the time, you may still be able to do so months later. However, it will be more difficult to get the case prosecuted.
*The police will need to agree to investigate the case. *The prosecutor may decline to press charges, especially if it has been a long time since the assault. *The defendant will likely argue that you had a motive for pressing charges months later, such as extortion. *The jury may be less likely to believe you if you changed your mind about pressing charges. *It is generally not advisable to press charges months later, unless there is a good reason to do so.
If you were assaulted and didn't press charges right away, it will be harder to do it later. The police and prosecutor may not be willing to help you. The defendant may be able to convince the jury that you're lying. You have a motive for pressing charges. If you're thinking about pressing charges months later, talk to a lawyer first.
