Librarians have voiced concerns about the practical challenges this vagueness presents, noting the "heavy lift" involved in interpreting and implementing such an ambiguous mandate. This lack of clarity would leave libraries uncertain about how to comply, inevitably leading to widespread confusion and inconsistent application across the state's 251 public library systems. For instance, without a clear definition of what constitutes "material related to sexual orientation or gender identity or expression," libraries would face subjective and potentially arbitrary decisions on what content must be segregated, risking non-compliance or over-compliance.

Constitutional Concerns

Legal experts have raised significant "constitutional red flags," warning that the language within HB 96 could violate both state and federal free speech protections. A direct precedent exists in Arkansas, where a similar law mandating the segregation of materials was struck down in federal court for violating the First Amendment.
