Missouri law breaks sexual misconduct into three distinct categories. Each carries different levels of severity and penalties.

First-Degree Sexual Misconduct

Statute: §566.093 RSMo

You may be charged if you:

  • Expose your genitals in a situation likely to shock, offend, or alarm others
  • Engage in sexual contact in front of someone in a shocking or offensive context
  • Have sexual intercourse in public in front of a third party

Penalties: Class B misdemeanor (up to 6 months in jail and $1,000 fine); Class A misdemeanor for a second offense (up to 1 year in jail and $2,000 fine)

Second-Degree Sexual Misconduct

Statute: §566.095 RSMo

This charge applies if you solicit someone to engage in sexual conduct in a way that is likely to cause shock, offense, or alarm.

Penalties: Class C misdemeanor (up to 15 days in jail and a $500 fine)

Sexual Misconduct Involving a Child

Statute: §566.083 RSMo

This offense includes:

  • Exposing genitals to a child under 15 to shock, offend, or arouse
  • Coercing a child to expose their genitals or a female child’s breasts for arousing purposes
  • Using electronic means to induce a child to expose themselves

Penalties:
First offense: Class E felony (up to 4 years in prison and up to $10,000 fine)
Subsequent offense: Class D felony (up to 7 years in prison and up to $10,000 fine)
