You've exhausted all other options for your employment case, with mediation proving unsuccessful and a positive outcome seeming out of reach. Now what!

At this point, the next logical step is to proceed to court. This is the first episode in our series created to walk you step by step through the litigation process.

The focus of this episode is the initial filing called the complaint. The complaint establishes the foundation of your lawsuit, providing a concise overview. It outlines the basic details of the lawsuit, highlighting the location of the events, the statement of facts, and the laws allegedly violated.

Tom discusses the process of actually filing the complaint, either physically or electronically, stressing the significance of obtaining a file-stamped copy as proof of filing. This becomes especially crucial when facing time constraints, such as the statute of limitations deadlines.

Keep in mind that the complaint is only the beginning. Further development of the facts and additional details will occur as the case progresses towards trial. The complaint becomes a public document accessible through electronic filing systems used by federal and state courts.
