The Police Minister was unaware of Wally Haumaha's now-controversial comments surrounding the Louis Nicholas case, when he considered his appointment as a Deputy Commissioner.
Stuart Nash says they weren't provided to him when he was considering the appointment.
Cabinet is drawing up the terms of inquiry into looking at the process the State Services Commission went through with the decision to make Haumaha a Deputy Commissioner.
Nash told Mike Hosking one question will be what level of due diligence should the Commission reasonably do during an interview process.
"The other issue is what is too relevant when a person is applying for a role at this level. We are getting an independent person to look at these issues and let's see what comes out of that."
