Both turn regulation into a freeze-out tool—bar AI from contracts or drive token projects offshore—not because the underlying activity is broken, but because it refuses the demanded integration. One side wins in court on First Amendment or definitional grounds; the other side keeps rewriting the hurdles until submission happens anyway.
The new guardrails from CFTC/SEC harmonization sound clean on paper: tokenized securities stay securities, commodities get their lane, AI agents get studied not strangled. Harmonized MOUs, self-certification, substituted compliance. Yet they collapse against security pretexts. National defense doesnt honor fit-for-purpose—it weaponizes the ambiguity the reforms claim to fix. Builders get invited to onshore and innovate, right up until their tech touches the wrong list. Then its endless procedural redesign until the knee bends.
The missing pattern is enforcement asymmetry. Innovation policy talks about guardrails and liquidity in 24/7 tokenized markets. Security policy operates as veto power that bypasses those rules entirely. Crypto survived FTX through existing tools like central clearing; AI faces supply-chain designations that cascade into billions of lost revenue via cloud partners. Same regulatory vocabulary, opposite operational reality.
What looks like regulatory evolution is actually institutional muscle memory. The state modernizes the rulebook for frontier tech while keeping the same discretionary choke points that forced previous generations to choose between principles and market access.
