n the case of United States v. Hembree, the Fifth Circuit Court of Appeals reversed a conviction for possession of a firearm by a convicted felon. The court determined that the federal ban is unconstitutional as applied to the defendant because his sole previous felony was simple possession of methamphetamine. Under the modern legal framework, the government failed to prove that disarming an individual for mere drug possession aligns with the nation’s historical tradition of firearm regulation. The judges reasoned that while drug trafficking may justify disarmament, personal drug use does not share a sufficient historical analogue with Founding-era laws. Furthermore, a concurring opinion emphasized that the Bill of Rights serves as a necessary safeguard when federal power exceeds its enumerated constitutional limits. This ruling reinforces a case-by-case approach to felon-in-possession charges within the circuit.
