One of the two gag orders judges have imposed on Donald Trump in attempts to protect witnesses, court staff and prosecutors, has been stayed or paused by the DC appellate court pending an oral argument scheduled for November 20th. As the reporting indicates, each of the three appellate court judges who will sit on the panel for the gag order appeal was appointed by a democrat president. In the age of Trump, we are always asking the question, "who appointed this federal judge?" But it hasn't always been that way. Glenn also takes on the differences between how the Obama administration approached the task of appointing federal judges versus how the Trump administration approached the same task. Then, in a remarkable revelation, one of Trump's co-defendants in the Georgie RICO case, Jenna Ellis, told prosecutors that Trump's close aid, Dan Scavino, said that Trump had decided he would not leave the presidency even though he lost the election. Glenn discusses the evidentiary implications of that statement and what it means for both Scavino and Trump.
