InCredible Witness

When Your Evidence Is Not Valued

Listen Later

It is always a possibility that in the family court, despite your best presentation, knowledge and efforts your evidence is still not valued as seriously as you would have liked or hoped. Michael explains how to increase the likelihood of your evidence being given preference over others.

KEY TAKEAWAYS

  • Expert witness evidence supporting your conclusions can be very valuable.
  • Some parents can be very adept at using the right image and language to present an untrue picture to the court.
  • Judge’s decisions are only as good the evidence placed before them that they choose to prefer.
  • Say what you believe to be in the best interests of the child irrespective of what anyone else thinks.

BEST MOMENTS

‘My concerns were not seen as valid. I was asked how I reconciled or explained the fact that the independent social worker and guardian both independently come to the conclusion that the mother could meet her daughters needs.’

‘There was from my point of view a huge sigh of relief that the child had been removed from a parent who was clearly unable to care for her.’
