With the widespread legalization of Marijuana, Pro Marijuana groups are demanding that a roadside testing device similar to a Alcohol Breathalyzer be developed and used to determine individual impairment of a driver or employee in the workplace. The problem is this type of technology to detect individual impairment is years if not decades away even then.
The breathalyzers being tested today can detect the presence of Marijuana but with no impairment standard being set like there is for alcohol, the only use this device has is in telling you if an individual has Marijuana in there system NOT impairment. So if using the detection only from a Marijuana Breathalyzer to arrest, discipline or dismiss an employee for use is a real slippery slope that could have legal ramifications for any business owner making these decisions based on the reading of this machine.
So what hope does the public, workplace or business owner have in determining if an individual is impaired from Marijuana?
