Dayle Takitimu is a Senior Solicitor at Kahui Legal and her focus for this lecture will be drilling for oil and gas in the Raukumara Basin.

Dayle has worked extensively with Te Rūnanga o Te Whānau as both a co-negotiator and legal advisor in their recent foreshore and seabed negotiations. She has also represented clients in the Waitangi Tribunal and advised in relation governance and other Treaty settlement issues.

England was the first jurisdiction in the world to establish formal independent machinery to investigate and review alleged miscarriages of justice. Graham Zellick was, for five years, the second Chairman of the Criminal Cases Review Commission (covering England, Wales and Northern Ireland).

John Grace is a senior Australian commercial lawyer. He presently practices independently as an International Resource Lawyer. He is a former Freehills (Melbourne) partner, former Head of the firm's Energy & Natural Resources Group, former Chief Legal Officer of BHP Petroleum worldwide and former Legal Manager of the Australian National Line. He has been in private practice in Wellington, London and Perth.

With a career path taking him from Wellington to Perth to London, back to Perth and then to Melbourne; he will share anecdotes and some interesting experiences he has encountered along the way, with indications on how an up and coming New Zealand lawyer can forge his or her own path in law.

Stephen Cornell is Director of the Udall Centre for Studies in Public Policy and Professor of Sociology and of Public Administration and Policy at The University of Arizona where he also serves as a faculty associate with the Native Nations Institute for Leadership, Management and Policy.

He has written widely on Indigenous affairs, economic development, collective identity and ethnic and race relations.

Professor Cornell has spent much of the last 20 years working with Indigenous nations and organisations - mostly in the United States but also in Canada, Australia and New Zealand - on governance, economic development and tribal policy issues.

Margaret Wilson DCNZM, is currently a Professor of Law and Public Policy at Te Piringa Faculty of Law, and was previously elected as a List Member of Parliament in 1999 and was Speaker of Parliament from 2005 to 2008.

This presentation considers the legal/tax barriers to indigenous charitable organisations which are established to benefit tribal or clan groupings. In both Australia and New Zealand tax concession are granted to entities that are considered ‘charitable’ or ‘charities’. A major problem for indigenous charities has been the requirement under the common law that a charity cannot be for the benefit of family members. Such a restriction poses problems for Australian indigenous groups, particularly land rights claimants who are defined by a family or blood connection. In New Zealand several legislative amendments have been enacted to extend the meaning of charitable purpose and overcome this restriction so that Māori and other charitable organisations are not prevented from obtaining charitable status merely because their beneficiaries are related by blood.

Justice David Baragwanath looks at the Treaty of Waitangi past, present, and future.

The High Court decision handed down by Justice Fogarty in Clarke v Takamore on 29 July 2009 raises significant questions concerning the right to decide where a deceased Maori person is buried. Dr Nin Tomas analyses the judgment and the problems it poses for intercultural marriages where one party is Maori.

Dr Tomas is from Tai Tokerau. She is the principal investigator for Nga Tikanga Mate, a two year Research Project sponsored by Nga Pae o te Maramatanga.

The Attorney General looks at the role of the lawyer as advocate, starting from John Adams' defence of the accused in the Boston Massacre trial, through to some more recent cases.

The new South Pacific Regional Fisheries Management Organization (SPRFMO) is the latest in a long line of international organizations responsible for the conservation and management of living ocean resources. While this new player demonstrates some potential as a more effective steward of fisheries, it faces some important challenges. Most notably, the SPRFMO continues the use of bottom-trawling to harvest dwindling stocks of orange roughy. Proceeding from an international legal and policy perspective, this presentation analyses the SPRFMO in the context of other regional fisheries management organisations, discusses its ongoing challenges and potential for success.

Howard Schiffman is a Senior US Fulbright Scholar and visiting professor at Waikato University Faculty of Law. His Fulbright research examines the development of the new South Pacific Regional Fisheries Management Organisation. He is on the faculty of the New York University Environmental Conservation Education graduate Programme and is former Clinical Associate Professor of Global Affairs at NYU. He has taught public international law, international dispute settlement, international environmental law and environmental debates.
