  • What REALLY Happens When You Default on an MCA? | A Collection Attorney Explains

What REALLY happens when you stop paying back a Merchant Cash Advance (MCA)? Can lenders freeze your bank accounts, seize your assets, or even come after you personally?

On this episode of After the Advance, host Claudia Stefano and co-host, retired attorney Mike Walsh, sit down with Alex from Recovery of Judgment, a collection attorney who represents lenders and purchasers of future receivables.

For once, we're hearing from the OTHER side of the table.

Alex takes us behind the scenes of MCA collections, revealing what happens when a business owner defaults, how lenders pursue repayment, and why ignoring collection efforts can turn a difficult financial situation into a legal nightmare.

    In this episode, we discuss:

    • What happens before and after an MCA default

    • How UCC liens can disrupt business cash flow

    • Why closing your business doesn't necessarily eliminate your debt

    • Personal guarantees and how they can expose your personal assets

    • How judgments can follow business owners across state lines

    • What happens when multiple MCA lenders are fighting to collect

    • The dangers of stacking multiple merchant cash advances

    • How receiverships can result in losing control of your own business

    • Why breaking a settlement agreement can make negotiations even harder

    • Aggressive collection tactics and the growing need for industry accountability

    • How communication and professional debt restructuring can help businesses avoid unnecessary litigation

One of the biggest takeaways from this conversation? Just because your business closes doesn't mean your financial obligations disappear.

Alex explains how judgments, personal guarantees, and collection enforcement can create consequences that last for years. But he also shares why many lenders would rather negotiate a workable repayment arrangement than force a struggling business into closure.

With over 21 years of experience in the merchant cash advance industry, Claudia brings the merchant's perspective to the conversation, challenging collection practices while emphasizing accountability, transparency, and the importance of keeping businesses alive.

Whether you're a business owner struggling with MCA payments, a broker, a lender, or someone working in debt restructuring, this is a conversation you don't want to miss.

  • What REALLY Happens When You Default on a Merchant Cash Advance?

Absolutely. This episode is After the Advance with Claudia Stefano, and the strongest hook is what actually happens when a business owner can’t make their MCA payments—personal guarantees, arbitration, lawsuits, UCC liens, frozen accounts, and negotiation.

What REALLY Happens When You Default on a Merchant Cash Advance?

What happens when a business owner can no longer keep up with merchant cash advance payments?

On this episode of After the Advance, Claudia Stefano sits down with attorneys Paul A. Herman and Mike Walsh, bringing more than 75 years of combined legal experience to a conversation every business owner using alternative funding needs to hear.

They break down what can happen after an MCA default, including personal guarantees, lawsuits, arbitration clauses, UCC liens, frozen bank accounts, aggressive collection efforts, settlements, and the legal costs that can come with trying to fight back.

They also explain an important distinction many merchants don't fully understand: signing on behalf of your business doesn't necessarily mean you're protected personally. And because merchant cash advances involve business debt, many of the protections associated with traditional consumer debt may not apply.

The conversation also explores why MCAs can be either an incredibly useful source of capital or a business owner's worst enemy. Used strategically, an advance can help a business grow. But stacking multiple advances and using new funding simply to survive can quickly create a cycle that's extremely difficult to escape.

Most importantly, Claudia, Paul, and Mike explain why waiting until your accounts are frozen or a lawsuit arrives can severely limit your options and why getting ahead of the problem, communicating honestly, and working with people who understand the MCA industry can make a major difference. • He Was Promised $425,000… Then Realized It Was a Scam | After the Advance

Gary thought he was finally getting the lifeline his business needed. Instead, he says it turned into a nightmare that left him with four merchant cash advances, more than $10,000 a week in payments, and thousands of dollars lost to alleged scams. Pasted text

On this episode of After the Advance, Claudia Stefano sits down with Gary, a kitchen design business owner, to tell the story from the beginning.

It started with a cash-flow problem. A developer owed Gary money, expenses kept coming, and an MCA seemed like a way to bridge the gap. He paid the first advance, refinanced, then eventually took additional advances to keep up with the payments. Before long, he was juggling three positions and looking for a way out. Pasted text

That's when Gary says the promises started getting bigger.

One broker allegedly offered to consolidate his existing positions into a longer-term deal. Gary says a $45,000 advance followed, along with $9,000 in fees—and the larger promised financing never arrived. Pasted text

Then came an even bigger offer: a supposed $425,000 line of credit. Gary says he was shown what appeared to be a legitimate company, documents and an online banking portal. The catch was a $17,000 security deposit. He wired the money.

The $425,000 never came. Pasted text

Gary shares what happened next, including his attempts to trace the money, report the alleged fraud and keep his business alive while dealing with mounting MCA payments.

Claudia also breaks down the warning signs business owners should look for before accepting an advance: know who your broker actually works for, verify the funding company yourself, understand every document before signing it, and don't let desperation rush you into a deal you haven't fully checked.

This is exactly why After the Advance exists—to show what can happen after the money hits the account and give business owners a better understanding of the MCA world before they find themselves trapped.

Note: Allegations involving specific individuals and companies in this episode reflect Gary's account of his experience and have not been independently verified by the podcast.

  • Your Broker Got Paid… But Did You Get Played? | After the Advance

Your broker promises better financing is right around the corner. You take the merchant cash advance, make the payments, and then suddenly you’re carrying three, four, or even six MCAs at once. What happened?

On this episode of After the Advance, Claudia Stefano sits down with Christina from Capybara Capital to have a conversation merchants rarely get to hear: the MCA industry from both sides of the table.

Claudia has spent more than 21 years in the merchant cash advance industry working with business owners, lenders, brokers and investors. Her goal with After the Advance is to talk openly about the good, the bad and the ugly of an industry that can provide businesses with needed capital—but can also create serious problems when the wrong decisions are made.

Christina explains what happens on the funder's side of an MCA, including how brokers get paid, how Capybara vets brokers, why commissions can be clawed back, and why merchants should know exactly who is providing their money—not just the broker who brought them the deal.

They also get into some of the practices they've encountered in the industry: brokers promising SBA or traditional financing, stacking multiple advances, excessive broker fees, merchants signing agreements they don't fully understand, and what can happen when a business starts struggling with daily or weekly payments.

Christina even shares a recent example involving a $70,000 advance where she discovered the broker had charged the merchant an additional 5% fee on top of the commission the broker was already receiving.

The biggest message for business owners is simple: know your broker, know your funder, ask questions, and understand what you're signing before the money hits your account. Claudia and Christina also explain why communication with the funding company can become especially important when a business starts having trouble making its payments.

Merchant cash advances can serve a real purpose for businesses that need working capital quickly. This episode is about understanding the people, money and decisions behind the advance before one funding agreement turns into something much bigger.

  • The Wild West of Merchant Cash Advances | Welcome to After the Advance

Welcome to After the Advance, the podcast pulling back the curtain on the merchant cash advance industry and giving a voice to the people on every side of it.

Host Claudia Stefano brings 21 years of industry experience to conversations about what really happens before, during, and most importantly, after the advance.

Merchant cash advances can provide critical capital to small and medium-sized businesses that may not qualify for traditional bank financing. For some entrepreneurs, that funding can create an opportunity to grow and succeed. For others, one advance can become two, three, or more—until daily and weekly payments begin consuming the business's receivables.

Claudia has seen the good, the bad, and the ugly.

After years of explosive growth—particularly since COVID—she believes the MCA industry has become the “Wild Wild West.” Brokers, lenders, merchants, restructuring companies, collections professionals, and other players are operating in an industry where accountability, transparency, and education are more important than ever.

After the Advance is where those conversations happen.

Claudia will sit down with lenders doing right by their merchants, brokers who put their clients before commissions, business owners with incredible success and failure stories, restructuring professionals, collection companies, and even some of the industry's most controversial players.

    Nothing is off the table.

What happens when a business owner becomes buried under multiple advances? What exactly is a reverse consolidation? When should a lender work with a struggling merchant? What responsibility does a broker have after the deal closes? And how do you separate the legitimate companies from the bad actors?

Claudia also wants to expose the practices hurting small businesses while shining a light on the lenders, brokers, merchants, and professionals who are doing things the right way.

Because ultimately, this isn't about choosing one side.

It's about creating a better industry.

Expect real stories, real money, real consequences, uncomfortable conversations, success stories, failures, education, accountability, and a few “frenemies” along the way.

    This is After the Advance.
