‘My friend divorced his wife in anger. She wasn’t there when he divorced her. Please comment on this.’
Summary:
- In Pakistan, people do this and regret it later. So they go to a religious cleric (molvi) who tells them that it is okay for them to live together again despite them being divorced. This is forbidden (haram).
- In our society, we tend to think that a divorce is only valid when you say, ‘I divorce you,’ three times. However, you only say ‘I divorce you,’ once to issue a part of the divorce. It is forbidden in Islam to give all three parts of the divorce (Triple Talaq) at the same time.
- A Halal is also forbidden in Islam because your intentions are fraudulent when you do it. It is just as forbidden as deceitfully expressing your intent to perform Itikaf just so you can eat in the mosque; you can only eat and drink in the mosque when you actually perform Itikaf.
- According to Islam, if you only give your wife one part of the divorce, reconciliation is possible and permissible within 2-2.5 months of that divorce.
- You can only remarry your wife once you have divorced her three times if, naturally, she has married another man and been divorced by him too. This has to all have been done unintentionally.
