Ms. Chenée Riley, General Counsel at the Office of Utilities Regulation in Jamaica joins Nicola Berry, of Berrys Attorneys & Arbitrators in the first episode of our podcast series “Berrys Legal Brief” to discuss Power Purchase Agreements (“PPAs”). They discuss Power Purchase Agreements as an innovative approach to energy procurement that can promote growth by offering a long-term contract, giving projects the confidence to attract investment.
The podcast discussion covers how PPAs are regulated in Barbados and Jamaica, the key provisions of a typical PPA and how challenges such as the delay in achieving the commercial operational date, changes in the applicable law, and force majeure events are handled. It also covers the approach to pricing and some of the financial issues which are addressed in the PPA including some of the matters which project lenders will want to see in the PPA for it to be acceptable to them. Finally, the discussion also covers other matters which are addressed such as typical security interests, some of the related project agreements and dispute resolution provisions.
