Recentelijk wezen zowel ESMA als de AFM erop dat het risico op greenwashing ook bestaat in de financiële sector. Om greenwashing tegen te gaan, komt de Europese Commissie met een nieuwe taxonomieverordening die strenger controleert op duurzaamheidsclaims. More than 18 months ago the day had finally arrived. After years of discussions, consultations, draft and ultimately definitive texts, MiFID II entered into force, one year later than planned. Since 3 January 2018, all investment companies in Europe have had to comply with MiFID II.

I can hear you think: “January 2018? Old news! Surely that’s no longer relevant?” In fact, the opposite is true. The European regulator (ESMA), the European Commission and the Dutch regulator (AFM) have not sat idle over the past 18 months.

Clever use of tax havens. A radical form of creative bookkeeping. It is permitted by the law, and therefore it happens. But the fact that tax avoidance is legal does not mean that this doesn’t involve any risks for the banks. Ruim anderhalf jaar geleden was het zo ver. Na jaren van overleggen, consultaties, ontwerpteksten en uiteindelijk definitieve teksten, trad MiFID II – 1 jaar later dan gepland – in werking. Vanaf 3 januari 2018 moesten alle beleggingsondernemingen in Europa aan MiFID II voldoen.

Ik hoor u denken: “Januari 2018? Oud nieuws! Dat is nu toch niet meer relevant?”. Het tegendeel is echter waar. De Europese toezichthouder: ESMA, de Europese Commissie en de Nederlandse toezichthouder: AFM hebben de afgelopen 1,5 jaar niet stil gezeten.

Slim gebruikmaken van belastingparadijzen. Een vergaande vorm van creatief boekhouden. Het mag wettelijk en dus gebeurt het. Maar het feit dat belastingontwijking legaal is, wil niet zeggen dat hier geen risico’s aan kleven voor banken.
