In this, the second of our series Conveyancing Around the World, we are delighted to welcome Michael Joyce, from The College of Law Australia, to Conveyancing Matters. We had an interesting chat to him about the conveyancing process in New South Wales, Australia.

We were surprised at some of the processes, and there are others which we might hope to adopt.

In their regular monthly news roundup, Lorraine and Stu talk about some of the news stories that have caught their eye.

First up, they talk about the event of the month – the first Conveyancing Matters Live!  It was a great success and Lorraine and Stu thank everyone for their support.

There are some HMLR changes that will help practitioners manage risk and they talk about changes to the Help to Buy application deadline.

Stu and Lorraine also mention the interesting decision by the Competition and Markets Authority which requires a large search provider to divest itself of the recently acquired TM Group.

In this Conveyancing Matters chat, Lorraine and Stu discuss a County Court case reported by the Law Society’s Gazette in which a conveyancing firm avoided a negligence claim because their terms and conditions did not extend to advising the client about road development schemes in the locality.

The case does not set a precedent – but it is interesting as it shows how important it is for conveyancing firms to have well drafted T&Cs setting out what a firm will do for a client in a conveyancing transaction.

Lorraine and Stu discuss some of the learning points from the case for conveyancers including the importance of understanding what searches are for and how and when to apply for some of the more unusual searches.

They also talk about the importance of having a good search provider!

Russia’s invasion of Ukraine has led to international condemnation and a raft of economic sanctions against Russia and many of its citizens.

In this explainer Conveyancing Matters chat, Lorraine and Stu consider what the SRA, Law Society and CLC have said about sanctions and the steps that law firms should take. They go on to consider how sanctions might impact on firm’s AML and due diligence processes for conveyancers at the coal face.
