The eighth-circuit affirmed the district court’s denial of a downward departure to house arrest and its imposition of a 120-month prison sentence for unlawful possession of a firearm by a convicted felon or one under indictment, in violation of 18 U.S.C. §§ 922(g)(1), 922(g)(3), and 924(a)(8). The court held that the district court did not clearly err in determining that Rankins’s physical impairments, including paraplegia and chronic health issues, did not constitute an “extraordinary physical impairment” under U.S.S.G. § 5H1.4 because he failed to present evidence that his condition was substantially more dangerous for prisoners than for non-prisoners or that the Bureau of Prisons could not accommodate his needs. Furthermore, the court found the sentence substantively reasonable, noting that the district court properly considered the 18 U.S.C. § 3553(a) factors, including Rankins’s mitigating circumstances and the severity of his offense involving drugs and multiple guns, without abusing its discretion. The judgment of the district court is affirmed.
