If you're doing things the way you're supposed to during a divorce, you have a responsibility to disclose all the marital assets. The parties are going to litigate ownership over those assets. What if the spouses are separated? Separated for a long time now. You never got divorced. Now finally you're getting a divorce. Are spouses obligated to disclose those assets acquired after the separation? The short answer is yes. Until you're divorced, you are married. It's kind of binary. You're married or you're divorced? If you're not divorced, then you're married. Being separated is not really meaningful in the context of your marital assets. You have been separated. Each with your own separate life. Are you still obligated to disclose assets after the separation? Probably not but you don't want to be caught failing to disclose. Both sides need to disclose. The court will most likely pick a point during the separation. It can start its determination from that cut-off point. If you fail to disclose you will lose credibility with the court. The court will start wondering what else you have not disclosed. Your lawyers can always agree on that cut-off.

The finality of your divorce. A divorce with minor children can easily go a minimum of six months. It can easily go 6 to 12 as parties are wrangling back-and-forth and doing a lot of horse trading. At some point that case will go to trial. There will be judgment based on that. There parties can have a settlement. Judgment will be based on that settlement. It will be resolved. The question is the finality. Is the judgment of divorce final? Can your ex-spouse change the terms of the judgment of divorce? The quick answer is NO. It's done. The judgment says what everybody gets. That's it. Having said that. It's possible to make certain modifications under very limited circumstances. You can't modify it based on buyer's remorse. You can modify it based on fraud. Modify it if you learn someone hid some assets. Bring it to the attention of the court. Unless you have substantial reason behind it. Unless you can show a compelling evidence the court will not likely modify it. At least this is the case with property settlement. There are somethings that are never final. Custody and child support is never final. Parenting time is never final. The court can always do that. The court of course doesn't do it on its own. Appropriate motions have to be filed. Present compelling evidence of substantial change in circumstance.

Conflicts regarding school. In a regular relationship, if there are children, the parties will always agree on Labor Day. Parents can never standstill about the choice of school. They will make a choice in time for the school opening. You never hear of couples breaking up because they couldn't agree on the school. Somehow when the parties are divorced all of a sudden the couples can't figure out choosing a school. You have to look at who has authority. The choice of school is part of legal custody. In most cases, the parties share legal custody. The parties share in the decision-making. The parties should sit down and talk about it. Look into the pros and cons of each choice. If parents cannot work it out, a motion should be filed in court. The court will conduct an evidentiary hearing to hear the parties out. Assess what's in the best interest of the child. The court can send the parents to a mediator. Mediators are not magicians so it will not always work out. The courts will have to make a call. The parties may have to live with the court's decision. Each case will be unique.

Custody issues can come up anytime. They know no season. They know no economy. They seem to come up no matter what the situation is. Parents always fighting about their kids. They have been doing it since the dawn of divorce. They have been doing it since the beginning. There will always be custody issues that come up as parents wrangle for a position. They jockey for position with children. In summer there's more flexibility. When school starts, there's more structure. Divorce couples have always something going on. There's a powerful agent at work. You want to get at the good side of your child. You ease on restriction. In the process, you have homework that don't get done. The child goes back to the parent with work undone. There are conflicting interests. What you can do is share the load. Each time the children is with the other parent, they should set aside equal time for homework. Both parents can do it for children who are falling behind school.

What is supervised visitation? What does it really mean? The court tries to maintain the parent-child relationship that existed. The relationship that existed before the divorce proceeding. If the parent has a normal family situation the court won't find any reason to alter the situation. The court requires a supervisor in a supervised visitation when something out of the ordinary is happening. One of the parents is now addicted to drugs. The court may be concerned. The parent in an unsupervised arrangement, might take the child away. Putting the child in a dangerous situation. Supervised visitation is not meant to be permanent. It is designed to address a situation. The situation that existed before requiring supervised visitation may no longer exist. The court can order the lifting of supervised visitation. You are a recipient of a default judgment of divorce. What are you going to do? What is the appropriate thing to do? There are different things that cause a default. It could be that you got the papers. You look at them. You didn't think there was anything to fight about. A default judgment was entered against you because you chose to do nothing. In that circumstance, the likelihood is that there's not a whole lot to fight about anyway. If there was, you would have taken action. The more prevalent problem is you get a default judgment of divorce, you didn't even know the proceedings were going on. They are not home routinely. They were served with substituted service. Maybe they're estranged. They don't have much of a relationship with the ex-spouse. Now you have an onerous judgment entered against you. Call your lawyer immediately. There are time-sensitive things that have to be done to get the judgment overturned. When somebody sits on their rights too long it works against the court giving a favor. The lawyer will file a motion to set aside the default judgment. You will have to come up with legitimate reasons why you didn't respond.

Is there a custody arrangement you should look for when you're embarking on a custody battle? What would be considered a win scenario? People fall back on what they hear. One parent may have primary custody. The other parent has alternating weekends. One overnight in a week. Alternating weekends usually are Friday nights and return on Sunday nights. Eight overnights a month against the 22 for the primary parent. Is that fair? Maybe you'll rethink it. It's important to go for what makes sense to both parents. The arrangement must not impede the smooth transition to the new situation. It's not important what is good for the primary parent or the non-custodial. What is important is what serves the best interest of the child.

You want an increase in alimony. In most judgments, the court says that the alimony is in X dollars until further order of the court. The court often leaves the order open. The person can always come back and say the circumstances have changed. The compelling change of circumstances for that person allows an increase in alimony. The court conducts a hearing to find out the degree of change. Determine if such a change is substantial enough to warrant modification. The court then enters an appropriate order. What will you do if your motion is denied? You need to understand why it was denied. If it was denied for some procedural reason, it may still be cured. If the court has denied your motion based on the guidelines and factors, you may not get reconsideration. You can do a motion for reconsideration only if you submit a new factor. Or new evidence not known at the time. It will become a simple filing and then a ruling. Should you go to the Court of Appeals? You can always talk to your lawyer. Your lawyer is going to explain if it is worth your resources to pursue an appeal.

There's a situational factor associated with alimony. An example is an ex-spouse who is in jail. Can you get alimony? Alimony from who? Your ex-spouse is in jail. The ex-spouse is in jail. There is no income. The quick answer is no. You're not getting alimony because there's no income. That's the quick answer. There's also the slow answer. Sometimes there are situations where incarceration does not stop income. You might still get alimony. An example is a spouse who has family wealth. Your ex-spouse is living off that family wealth. A trust-fund child. Your ex-spouse has supported you with that passive income. Your ex-spouse was unlucky. Took to drugs. Ends up in jail. The incarceration has not stopped the income. It means you might still get your alimony. There might be restrictions or limitations. There might be some red tape but incarceration will not necessarily rule you out of alimony. Consult your attorney for the specifics of your case.

How long a person should wait in order to get rights that were taken away before reinstated? It can be divorce where the court issued that parenting time be supervised. How long can you do supervised parenting time before it gets lifted? Remember that your idea of a timetable may not be shared by the court. Your idea of a timetable can also be different from your attorney's view of a timetable. Ask your attorney about the parameters of the supervised visit. You need to be aware. You need to demonstrate sustained improvement in that situation. It will be that until your attorney or the court can say it's okay to take a chance. If you drove the children around while intoxicated. You will have to show proof of your sobriety. Without proof, the court will not risk the children's safety. The court will always be looking at what is in the best interest of the children. The court will always act on the side of caution when it comes to deciding matters related to the children. Between trampling the rights of the children and your rights. The court will trample on your rights to protect the children.
