Dred Scott And Roe V. Wade

Bryan Fischer here with the Life & Liberty Minute. The Supreme Court is taking up a case that directly challenges Roe v. Wade. The left is banking on the bankrupt judicial theory of stare decisis, the conceit that prior Court rulings must be slavishly followed today. But Dred Scott gives the lie to this idea. The Court ruled in 1857 that Scott was the property of his slave master, and had to be returned to him. But if stare decisis is valid, then slavery would still be legal in America today on the grounds that precedent is sacred and binding. Abraham Lincoln refused to accept the idea that the Scott decision set precedent anywhere in the United States. Well, if Dred Scott didn’t set binding precedent, then neither does Roe. Abortion violates the right to life, found in the Declaration and restated in the Constitution. Bottom line: Roe has got to go.
