Bryan Fischer here with the Life & Liberty Minute. The Supreme Court is taking up a case that directly challenges Roe v. Wade. The left is banking on the bankrupt judicial theory of stare decisis, the conceit that prior Court rulings must be slavishly followed today. But Dred Scott gives the lie to this idea. The Court ruled in 1857 that Scott was the property of his slave master, and had to be returned to him. But if stare decisis is valid, then slavery would still be legal in America today on the grounds that precedent is sacred and binding. Abraham Lincoln refused to accept the idea that the Scott decision set precedent anywhere in the United States. Well, if Dred Scott didn’t set binding precedent, then neither does Roe. Abortion violates the right to life, found in the Declaration and restated in the Constitution. Bottom line: Roe has got to go.

It’s called stare decisis, a Latin phrase which means “let the decision stand.” It’s the theory that once the Court has issued an opinion, that opinion must be applied in all subsequent decisions, even if the opinion is fatally flawed. This is the only thing propping up Roe v. Wade. Even regressive justices believe Roe was wrongly decided, but they continue to affirm it just from inertia and habit. They’re afraid to correct their terrible ruling from 1973, and so 63 million babies have suffered excruciating deaths. But a terrible ruling is terrible no matter how long it’s been around. The Court will have the chance to correct this monstrous evil in a case from Mississippi. Let us fervently pray that this time they will choose life.

The Founders called the Second Amendment “the palladium - or protector - of our liberties.” But Joe Biden’s understanding of it is so skewed that he recently said the Amendment quote “limited the type of people who could own a gun, and what type of weapon you could own.” Said the Washington Post, not exactly a charter member of the NRA, “Everything in that statement is wrong.” The Post gave him 4 Pinocchios, the equivalent of their liar, liar, pants on fire award. The truth is that when the Second Amendment was ratified in 1791 there was not one federal law regulating the kind of gun you could own. In fact, privateers even owned their own cannons. All this raises the question: If president Biden could be this wrong about the Second Amendment, what does he have wrong about the rest of the Constitution?

But it turns out that ordinary black Americans don’t agree with them. This is simply because they live in crime-ridden neighborhoods and are quite conscious of the need for a visible police presence in their communities. White liberals have been shocked to discover that the leading vote-getter in the race for mayor of New York City is Eric Adams, a black former police chief who campaigned on expanding rather than abolishing or even diminishing the law enforcement presence in the Big Apple. Black and brown voters have flocked to his campaign, because they want to live in a crime-free city just like everybody else does. And they wisely think the best way to get there is behind a mayor who vigorously supports the cops.

Note, not the freedom to believe what we want, but the freedom to actually exercise our Christian faith and follow its teachings. The Democrat Party has completely lost sight of this fundamental civil right. The Catholic Church is drafting a document that will urge priests to refuse communion to any politician who defends the butchering of babies in the womb, including the president. Democrats, who either don’t understand the Constitution or don’t care, are determined to strip tax exempt status from the Catholic church in retaliation. Democrats are prepared to add to their sin of abortion the sin of prohibiting the free exercise of religion. We now must defend the Constitution and religious liberty from those who have a sacred, sworn duty to protect it.

Evidence continues to mount that lockdowns, the tool of choice among power-hungry politicians during COVID, may not have helped but made things worse. USC and the Rand Corporation examined data from 43 countries and all 50 states. The study notes, “We fail to find that shelter-in-place policies saved lives.” In fact, they actually contributed to an across the board increase in avoidable deaths. This is in part due to the fact that most COVID spread occurred at home, making shelter in place orders especially harmful. Politicians always tell us they can solve our problems if we just give them more power. The lesson from COVID: the more power we give to our elected officials, the more trouble they will cause for us. As Thomas Jefferson said, that government which governs least governs best.
