Action items for today. 

  1. If you are currently working with someone and you have a spoken agreement, remember that if something goes wrong, people have a tendency to remember the best parts of the contract and forget the parts causing them to pay.  Not having a contract can separate the best of friends or hurt family relationships.  If you don’t have a contract, go through the different musts that Dave talked about, and ensure that you’ll know exactly what will happen in case of default, death, divorce, disability, drug use, disinterest, and destruction. 
  2. If you do have a contract currently, pull it out and look through it. Do you address everything from action step #1?  If so, great.  Is it also written in a win win manner, and has everyone read it and own their own fully executed copy?
  3. Does someone currently owe you money and you’re debating whether to sue them?  Go through Dave’s recommended procedures and ask the humbling question if you or your company are at fault.  If you’re still wanting to sue, please heed Dave’s warning that each time he has gone that route, it was for a moral reason, it cost them a lot of money, and they didn’t get anything financially in the end.
