On June 25, 2024, WikiLeaks founder Julian Assange was able to walk free following a deal with the US government. Does this surprising end to the publisher’s many years of criminal prosecution and imprisonment signal a positive outcome for press freedom?

Turkish journalist Can Dündar, who was also imprisoned on similar charges in Turkey and now lives in exile in Germany, followed the Assange case for the last six months before his release. Dündar sees it as the most important trial for press freedom in this century. In this documentary, Dündar decides not to focus on the controversial figure of Assange, but instead on his most controversial publication: “Collateral Murder”, a video which shows possible war crimes committed by US soldiers in 2007 in an attack in Baghdad during the Iraq war. The recording shows journalists and Iraqi civilians being gunned down by US soldiers in an Apache helicopter.

Dündar’s investigations take him from Iceland to the US and Iraq, as he follows the story of the infamous video. He tracks down one of the only two Iraqi survivors of the attack – a boy who was 10 years old at the time – and a US soldier who was directly involved in the incident. Dündar invited the two to meet for the first time 17 years later. The encounter makes the disturbing long-term consequences of war and the lasting pain on both sides vividly apparent.

Following the publication of the video, the US military conducted an internal investigation, after which none of the soldiers were brought to trial. For Julian Assange, however, it was a different story: It was the first time in American history that publishing information the government considered secret was successfully treated as a crime.

Dündar was able to accompany Julian Assange’s wife, Stella, and their two children on one of their last visits to Belmarsh maximum security prison and to the hearings at Britain's High Court. Although Assange is now free, Dündar asks what the ruling means for journalism. What will happen if journalists around the world stop reporting on war crimes, corruption or government wrongdoing for fear of conviction under an espionage law? The long-term implications of the Assange case are only just beginning to emerge. The film tells a gripping and highly topical story about the fight for truth.

Pour lui, le journaliste australien est « un prisonnier d’opinion, un prisonnier politique, torturé ». Il parle d’une nouvelle affaire Dreyfus et évoque le courage de Stella Assange.

In an attempt to highlight the importance of whistleblowers, Julian Assange chose to have WikiLeaks' Collateral Murder footage as background for his speech at the Sam Adams Awards, an award dedicated to whistleblowers. The ceremony was organized by the Oxford Union. As a result of the video playing in the background and unsuccessful attempts to vet Julian's speech, the Union pulled the live stream from the event and spent two days substituting the US Army massacre footage with their logo. The Union claimed they feared that the US government would take legal action concerning "copyright" of the Apache gun camera footage. Wikileaks advised the Union that by law and practice the US government does not claim copyrights on footage or documents that it produces, the Union still decided to censor the video.

La juge bri­tan­nique Barait­ser, le 4 jan­vier 2021, a refu­sé l’extradition de Julian Assange vers les États-Unis pour des rai­sons : médi­cales. S’il était extra­dé, l’homme serait enfer­mé dans une pri­son de haute sécu­ri­té appe­lée “Super­max” et ris­que­rait de se sui­ci­der. Dans les pri­sons Super­max, les pri­son­niers sont main­te­nus en confi­ne­ment soli­taire et ne peuvent quit­ter leur cel­lule qu’une heure par jour. Les portes des cel­lules sont contrô­lées élec­tro­ni­que­ment et opaques afin d’é­vi­ter que les pri­son­niers ne se voient. Les meubles de la cel­lule sont faits en béton et inté­grés aux murs. Les tuyau­te­ries et les portes de la cel­lule sont iso­lés pho­ni­que­ment afin d’empêcher toute com­mu­ni­ca­tion entre déte­nus. Durant les “pro­me­nades”, les déte­nus ont les mains menot­tées dans le dos et les fers aux pieds. Les acti­vi­tés ou le tra­vail sont géné­ra­le­ment inexis­tants. En jan­vier, la juge bri­tan­nique Barait­ser a refu­sé l’extradition d’As­sange pour des rai­sons médi­cales. Dit autre­ment : la juge a accep­té les accu­sa­tions por­tées par les pro­cu­reurs amé­ri­cains contre Assange, contre son tra­vail de jour­na­liste. La publi­ca­tion de docu­ments clas­si­fiés – de crimes de guerre avé­rés – est, du point de vue de la jus­tice bri­tan­nique, un crime.

Les textes de loi sont par­fois élé­gants, les décla­ra­tions des droits de l’homme admi­rables. Les phrases qui les consti­tuent disent ce qui doit être fait, pour le bien de toutes et tous, mais quand est-il dans la pra­tique ? La fin a tou­jours jus­ti­fié les moyens des puis­sants qui ont des choses à cacher.
