Judge Kavanaugh wrote the opinion which required the Nuclear Regulatory Commission to continue work on the controversial Yucca Mountain nuclear waste dump in Nevada.

Opposition from tribes and the state prompted the Obama administration to suspend funding for the project, which is located on land promised to the Western Shoshone people under the 1863 Treaty of Ruby Valley.

Despite the ruling, the site remains in limbo due to opposition in Nevada.
