August 03, 2021 'A federal trust responsibility'
Rep. Tom Cole (R-Oklahoma) discusses efforts to address the U. S. Supreme Court decision in McGirt v. Oklahoma.
The 2020 decision confirmed the existence of Indian Country in eastern Oklahoma, meaning tribes and the federal government exercise jurisdiction over most criminal activity. But Cole said the federal government has failed to provide adequate funding for tribal justice systems.
"There's clearly a federal trust responsibility to provide for justice and law enforcement on Indian reservations," Cole said during a meeting of the House Committee on Rules on July 26, 2021.
Through an amendment to an appropriations bill, Cole sought an additional $154 million in federal funds to address the situation. The money would have been added to the budget for the Bureau of Indian Affairs.
Lawmakers, however, rejected the amendment as part of a vote that took place on the floor of the U.S. House of Representatives on July 27. Despite the setback, Cole said he plans to continue working on the issue.
The funding bill is H.R.4502. It passed the House on July 29.

The 2020 decision confirmed the existence of Indian Country in eastern Oklahoma, meaning tribes and the federal government exercise jurisdiction over most criminal activity. But Cole said the federal government has failed to provide adequate funding for tribal justice systems.
"In Indian Country, only the federal government and tribal law enforcement officials can prosecute Indians who commit crimes, again, on Indian reservations. That, obviously, in the state of Oklahoma, will now call for enormously robust federal law enforcement and tribal law enforcement capabilities," Cole said on the floor of the U.S. House of Representatives on July 28, 2021.
Through an amendment to an appropriations bill, Cole sought an additional $154 million in federal funds to address the situation. The money would have been added to the budget for the Bureau of Indian Affairs.
Lawmakers, however, rejected the amendment as part of a vote that took place on July 27. Despite the setback, Cole said he plans to continue working on the issue.
"Regardless, that Supreme Court decision, the McGirt decision, means the federal government and tribal law enforcement officials must do more in this area. Again, one of the bills in front of us helps with regard to the federal government. I am hopeful, in the final negotiations, we can do more on McGirt," said Cole, who is a citizen of the Chickasaw Nation.
The funding bill is H.R.4502. It passed the House on July 29.

August 02, 2021 Alyce Spotted Bear and Walter Soboleff Commission on Native Children Act
The U.S. House of Representatives considers S.325, a bill addressing the Alyce Spotted Bear and Walter Soboleff Commission on Native Children Act, on July 26, 2021.
The bill extends the deadline for the Alyce Spotted Bear and Walter Soboleff Commission on Native Children to conduct its work. Members of the commission will be given another two years to study ways to improve health, education and other outcomes for American Indian, Alaska Native and Native Hawaiian youth.
"The Commission is tasked with conducting a comprehensive study of
federal, state, local, and tribal programs that serve Native children
with the goal of developing a system that delivers wraparound service
for Native youth," said Rep. Don Young (R-Alaska), who introduced the House version of the bill.
"The Commission was put in place, as I mentioned, in 2016, but was not able to have its first meeting until 2019," Young added. "Further meetings were delayed by COVID, and as we know, things weren't really going according to scale."
S.325 was considered under a suspension of the rules but a final vote was not taken before the House went on break for the month of August. The bill has already passed the U.S. Senate.
However, the same two-year extension is contained in an appropriations bill that passed the House on July 29.
