To end the 2 part series of how to resolve cross border #intellectualproperty disputes in the digital era, this episode of #IPSERIES focuses on the implication of recreating a dress design inspired by another fashion designer without acknowledging where the inspiration was gotten.

The case between #LafalaiseDion and Abiodun Folashade Tokunbo CEO of Anjy Luminee Couture, also known as House of Luminee, over the famous #cowriedress which broke the internet last year during the #MissWorld contest won again at the premiere of #KingofThieves on 3rd April 2022.

Lafalaise Don an Ivorian fashion designer in a publication accused the Nigerian fashion designer Abiodun Folashade Tokunbo of copying and reproducing her design without acknowledging her a publication dated 5th April 2022.

In this kind of situation should the designer be held liable or the consumer who intends to wear the dress? I discuss what legal protection fashion designers enjoy, and the best form of intellectual property protection and also made some recommendations.
