A Humboldt County judge issued a split ruling this week - upholding an arrest, but rejecting a search. The judge ruled that police went too far when they seized a Cal Poly Humboldt student activist’s phone, computer, and other devices — finding the warrant behind the search did not justify the seizure, and warning that treating mere possession of a device as grounds for seizure would render the Fourth Amendment toothless.
