Pennsylvania, New Jersey and Delaware are among a group of 23 states suing the Trump administration over an executive order on mail-in ballots.
President Donald Trump’s order requires the creation of a national list of eligible voters and instructs the postal service to deliver ballots to only those on the list.
The states say this is a violation of the Constitution, which gives states primary authority to administer elections.
New Jersey Attorney General Jennifer Davenport says voting by mail is safe and secure and has become increasingly popular in New Jersey over the last two decades, accounting for up to 30% of ballots cast in the last five years.
President Trump says the cheating on mail-in voting is legendary, and the order was written to address what he describes as long-term vulnerabilities.
