Picking up on the tail end of yesterday's stream, Norm and Mike dive deeper into the story breaking around the very public resignation of FTC Commissioner Christine Wilson. In particular, the FTC is planning to unveil its new rule to impose a nationwide ban on employers' use of covenants not to compete, colloquially "noncompete agreements." What is a noncompete agreement? How does one function? What are the mechanisms of enforcement? Perhaps most importantly, is the noncompete agreement the inherent evil Lina Khan and the FTC are advertising it to be?

Day 33 of the trial in United States v. Joseph Biggs, et al. begins today. Will Norm have to represent co-counsel in a sanctions hearing? The Wall Street Journal reported the impending resignation of Commissioner Christine Wilson from her position at the Federal Trade Commission. In a stunning and public resignation letter, the lone Republican Commissioner leaves no doubt as to the reason for her departure—corruption. Mike has been vocal about the individual acting as proxy for the shady government practices and unusual, damaging changes to the legal precedent by which the FTC has gone about its business in recent years. Her name is Lina Khan. Khan is only 33 years old. She was appointed Chair of the FTC by President Biden in January 2021.
Norm opens the show with a discussion of the ongoing issues affecting Trump, including an analysis of the Crime-Fraud Exception to the attorney-client privilege and whether VP Pence may take advantage of the protections of the Speech and Debate Clause reserved for the legislative branch of our government.

Day 32 of the trial in United States v. Joseph Biggs et al. begins. Norm offers up an update from yesterday's court proceedings, specifically the fact that the jury has been made aware that there were in fact government-sponsored confidential informants embedded within the ranks of the Proud Boys on January 6, 2021.

In perhaps the most tense week of witness examination in the United States v. Joe Biggs, et al. seditious conspiracy trial, Norm makes time to pick up a developing story of pretty dominant intrigue.
Just days following the publishing of explosive back-to-back undercover videos wherein a Pfizer Global Director of Strategic Development makes credible and troubling statements about Pfizer's ongoing efforts to mutate the underlying virus, James O'Keefe is apparently being pushed out of Project Veritas.
Norm and Mike discuss a strange search warrant issued against a Project Veritas reporter by a California police department in connection with what appeared to be a completely lawful engagement with a Youtube executive. They also discuss Youtube's role and responsibility in all of this, as both bombshell videos published by Project Veritas were promptly removed from Youtube for alleged violations of the latter's Terms and Conditions.

President Joe Biden addressed the newly constituted 118th Congress and the nation from the Capitol in Washington, D.C., on the evening of February 7, 2023. Norm and Mike discuss their own answers to the question, "What is the state of our union?" in parallel with a review and analysis of President Biden's speech.
By our their own admissions, Norm and Mike believe in their own ways that the United States of America is in the midst of one of the most historically salient periods of American cultural fracture and decline in pluralism. Norm gives his critique of the speech itself as a pathway into a broader discussion of what Mike considers an obvious void in American optimism and societal self-esteem.

It's Manic Monday!
Norm and Mike are back in the saddle as another week of court in the United States v. Joseph Biggs, et al. cranks up. With the jury excused from court for the day, the parties are scheduled to make arguments as to the admissibility of certain text communications between and among the defendants.
So? Norm starts with some foundational building blocks for what is "admissible" as evidence in a criminal trial. Through the lens of the Murdaugh trial ongoing, Norm gives #LALiens a window into how the federal rules of evidence treat various types of evidence, particularly evidence of a defendant's propensity, to illustrate the often elusive legal concept.
The two also discuss:
› The latest in the Chinese Spy Balloon story—what is the big deal?
› ChatGPT fails the Trolley Problem—Bigly!
