Who is legally responsible if someone drowns or is injured in your swimming pool?
Does it differ between homeowner and hotel? in Spain?
He asks because of a recent court judgment that has held up the Spanish ruling that anyone using the pool is responsible for their own safety, even if a lifeguard is working. Lawyers on behalf of British and German tourists keep trying to put the blame on the pool owner for any drownings or injuries. But so far, the Spanish courts have not taken this opinion unless the pool has no maintenance
