Just a couple of months after the state Supreme Court weighed in on Wisconsin’s administrative rulemaking process, Governor Tony Evers has filed yet another lawsuit against the state Legislature.
The ruling in July stripped away a legislative committee’s power to block proposed rules indefinitely. Republican leaders have previously used that power to stall a number of rules, including a statewide ban on conversion therapy for LGBTQ+ youth.
At issue now: whether state agencies still need sign-off from committees in the Legislature before submitting new rules for publication.
