In this episode Holly and Alannah discuss the main principles and importance of common law.  

Alannah's discussion of her coincidentally named cases [State (Quinn) v Ryan [1965] IR 70 and Attorney General v Ryan's Car Hire [1965] IR 642] explains precedent, Irish judicial activism in the 1960s and the elastic nature of case law.  

Holly's consideration of the seminal Donoghue v Stevenson  [1932] AC 562 provides an attempted  delineation of Ratio Decidendi & Obiter Dictum and the profound exclamation "Rot is rot!".   Also featured is discussion of the innate fear associated with car hire, ingenious legal themed pet names and the particularities of consuming an ice cream float.

In this episode Alannah and Holly discuss the importance of the Irish Constitution.  Alannah's discussion of her chosen case [Bederev v Ireland [2014] IEHC 490, [2016] IESC 34] features the separation of powers, unconstitutional legislation and the inadvertent legalisation of drugs.   Holly examines Latin grammar, illegal activity during referendums [McCrystal v Minister for Children [2012] 2 IR 726] and reviewing referendum results [Jordan v Minister for Children and Youth Affairs [2015] IESC 33].  This episode also features immaterial but entertaining consideration of the dangers of nutmeg, the concept of steep hurdles,  a legal Y2K and the hero we all need- Referendman.

Season 1 Episode 2 of our Irish law student podcast.

In this episode Holly and Alannah discuss the importance of the law, namely as a social tool. Holly’s discussion of her chosen case (State (Burke) v. Lennon [1940] IR 136) brought up unconstitutional imprisonment and prominent 20th century Irish political figures, with a slightly nihilistic conclusion. 

Alannah’s discussion of McGee v. The Attorney General [1973] IR 284 dealt with legalising contraception and the separation of church and state, with a decided emphasis on standing up for individual rights . 

As well as examining these cases to the best of their abilities, there was tangential conversation about dragging bodies into a court of law, the difficulty in creating new rights, and reducing women to marionette puppets.
