These days, doing a Google search and coming across a website or platform that can hook you up with designers or DYI designs are all the rage. Canva, Vistaprint, Upwork, you name it. They’re all over the web, they’re easy to use, and they’re more affordable than hiring a design firm to do the work for you.
All that being said, it isn’t as cut and dry as it seems. All of these sites have terms and conditions. You know those things that most people scroll through without reading, just so they can hit the “I accept” button? Yeah. Those. Those niggly things are actually pretty dang important when it comes to getting clarity on whether or not you will actually end up owning that design you just created or had someone throw together for you...yeah. It may not be yours at all. And you could end up copping some flak if you don’t do your homework before you have someone on Airtasker design a campaign for you. Are you clear on trade marks? Hello Everyone! Welcome to Episode 14 of Legals and Biz with Riz! Today, I’ll be talking about the 3 things that could be putting your business at risk.
When you have put every ounce of yourself into something - a new business, a new project or idea - you want to make sure that it has legs to stand on and that it’ll be a success. Watching all of that blood, sweat and tears crash down around you would be a devastating thing! And we refuse to stand by and let it happen! So. Here are a few things to think about while you’re sweating and tearing and…blood letting…? That’s a weird saying. But, we digress.
Here are 3 things that put your business at risk.
1️⃣ Not having a privacy policy. Get on this. It’s a legal requirement if you’re having clients or customers sharing any information with you at all, even just an email address for your newsletter. Cover your arse. 2️⃣ Not having legal contracts. A pinky promise or a hand shake just doesn’t cut it these days, folks. You have to get everything down on paper. Due dates. Pay rates. Number of revisions. Scope. Rights. Then make sure both parties sign on the dotted lines. 3️⃣ Not trade marking your brilliant brand and business! You may be thinking, hey I’ll get there once I start making money. But that’s a big ol’ mistake, friends. By that point, someone else could have swept your brilliant brand or business name right out from under you. Because you know, people can be jerks sometimes. So when you know you’re in it to win it, get on the trade mark.
These 3 steps can get you started on the right foot early on, so you can stay focused on your brilliant ideas and building that empire! Now get to it, friends!

How many times have you received one of those emails trying to sell you something from that gym you tried out once, or the e-card company you got a birthday card from 5 years ago? Maybe it’s an email about the latest craze in juicing. Whatever the detail, you know the ones we’re talking about. The ones you mark as spam or, if you aren’t too lazy the ones you unsubscribe from (but somehow they keep coming!!!). Anyway. Now you run your own company. And you’ve totally signed up for a Mailchimp account so you can start being THAT company. *Insert dramatic nnoooooo and drop to knees shaking fists in the air here* The truth of the matter is, commercial electronic advertising is an important way to remind your followers and fans that you exist and that you have big things coming down the pipe. What is commercial electronic advertising, you ask? It’s those emails and text messages you send to promote your business. But before you start getting email ad happy, there are a few things you need to know about.
1️⃣ Spam Act 2003 (Cth) is an Act passed by the Australian Parliament that regulates commercial email and other kinds of commercial electronic messages like text messages. Basically, this prohibits you from sending commercial electronic messages.⠀⠀⠀⠀⠀⠀⠀⠀⠀
2️⃣ The Spam Act has 3 key rules to stay legal. You need permission and/or consent to send your message, you can’t just blast someone who didn’t give you permission. You must include your contact information and you have to give the option to unsubscribe to the recipient on the message sent.
3️⃣ Exemptions exist if you’re a registered political party, governing body or a charity. In some cases too if you’re a place of education.
4️⃣ If you get caught breaking these rules, you could owe a pretty penny.
So pay attention. Get permission. Then tell your followers how awesome you are!
