As the Australian Taxation Office (ATO) chases $56 billion in tax debt owed by small businesses and individuals, victims of fraud and financial abuse have been caught in the firing line. When the tax system is used to perpetrate fraud and financial abuse, it's nearly impossible for victims to clear a tax debt entirely or to transfer it to the perpetrator. Victims of domestic and family violence, often become personally liable for tax debts that were created by their ex partners, leaving them mentally broken and financially crippled. Financial counsellors are calling on the ATO to undergo cultural change. They want ATO staff to be trained in dealing with cases of domestic violence. The federal government is also being urged to consider new laws to allow the ATO to waive debts borne out of financial abuse. The message comes as the tax office ramps up use of its powers to recover almost $56 billion dollars in debt, mostly owed by small businesses, and much of which is undisputed. The agency is hitting more people with Director Penalty Notices that make them personally liable for tax debts and give them just 21 days to pay. It's using more garnishee notices, which give the ATO the ability to take money directly from people's banks accounts. And it's reporting business debts more often to credit agencies, which then make it impossible for businesses to get loans. This harsher ATO action is seeing an unprecedented number of calls to the Small Business Debt Helpline and more complaints to the tax ombudsman. There are widespread calls for the ATO to give people more time to pay tax debts, especially in cases of severe financial hardship.
