The Financial Markets Authority’s nine-month case against the men behind failed finance firms Viaduct Capital and Mutual Finance has been aborted, after the presiding judge declared a mistrial this morning. The lawyer for the Crown, Meredith Connell’s David Johnstone, tells NBR there has been an argument over the past several days about the late disclosure of information by the prosecution in the Auckland High Court case.
