In this episode, we introduce the first elements of the tort of negligence: duty of care and breach of duty of care.

We consider special relationships between claimants and defendants which give rise to special standards of care. We also explore some of the ways in which breach of duty is proved and some of the factors which courts take into account when determining breach of duty.
