In this episode, we introduce the next three concepts which relate to the tort of negligence: causation, remoteness and loss.
We explore some key tests applied by English and Welsh courts when determining factual and legal causation, as well as the effect of new intervening acts on the causal chain. Case law and textbook commentary introduce us to some important legal principles, as well as exceptional approaches taken by Welsh and English courts in particular cases, which we later apply to fact-based problems encountered by clients affected by negligence.
