In this episode, we introduce a topic that some refer to as a specialised form of private nuisance, whilst others describe it as a distinct tort: the rule in Rylands v Fletcher. We consider key case law and academic commentary to gain insight into the English and Welsh legal requirements for establishing and defending such claims in tort.
