  • Hey PepsiCo, Enforcing IPR Is Fine, But Suing Farmers Isn’t Okay

PepsiCo, the US-based food and beverages multinational, has sued nine farmers of Gujarat, some of them for Rs 1 crore each, for allegedly violating its intellectual property rights (IPR) in a registered potato variety. A court has given an injunction after finding that the samples were indeed PepsiCo’s variety, but the company might find it difficult to prove that the farmers obtained the seed illegally.

India has two laws for protecting agricultural IPRs. Genetically-modified (GM) traits like bollworm resistance and herbicide tolerance in cotton, for instance, being artificial nucleic acid sequences, are protected by the Indian Patent Act. India also has a unique law, enacted in 2001, which protects the rights of farmers and communities in plant varieties they have conserved over time.

The letter said that Gandhi had declared his nationality as British in an annual returns statement filed by a British company named Backops Ltd. The MHA has given Gandhi 14 days to file a response.
    • And the trouble for the Congress President doesn’t seem at an end. Rahul Gandhi issued an apology to the court, for wrongly stating that the Supreme Court had also said, “chowkidar chor hai”. Gandhi had been charged with contempt of court after a case was filed by BJP leader Meenakshi Lekhi over his statement. In his response he also stated that he had no intent of dragging the court into the political arena and that Lekhi was only seeking political mileage out of the entire issue.
    • The Election Commission suspended five polling officers in West Tripura for allegedly abetting booth capturing and attempting to further the prospects of some specific candidates winning. The EC is also likely to announce a repoll in at least 130 booths of the West Tripura constituency.
    • While the rest of the country was surprised when the BSP-SP-RLD alliance announced that they would be fielding former BSF constable Tej Bahadur Yadav, AAP chief and Delhi Cm Arvind Kejriwal praised the jawan for standing up to Modi.
    • If you remember, Tej Bahadur Yadav was dismissed from the BSF in 2017 after a video of him complaining about the quality of food served to the forces, went viral.
    • And the drama in West Bengal continues.
