What Are Transfer Fees in Thailand Property Purchases and Who Pays Them?
In Thailand, transfer fees are a mandatory cost associated with property transactions, typically set at 2% of the appraised value of the property. These fees are paid directly to the Land Department at the time of ownership transfer.
The payment of transfer fees is often negotiated between the buyer and the seller . While it's common for the two parties to split the fee evenly , the arrangement can vary. In some cases, the buyer may cover the entire fee, or it could be included in the final property price during negotiations.
Aside from the transfer fees, there are other charges involved in property transactions, such as:
Stamp duty (0.5% of the sale price or appraised value, if the seller is exempt from business tax).
Specific Business Tax (SBT) of 3.3%, which applies if the property is sold within five years of purchase.
Withholding tax (usually paid by the seller) based on the seller’s income bracket.
Since the payment responsibilities can be flexible, it’s essential to clarify these details in the sale and purchase agreement . Buyers should also budget for additional costs, including legal fees and property maintenance, to avoid unexpected financial burdens.
