This case was asking the Supreme Court to issue an emergency stay of an EPA rule. I talk about the rules surrounding the issuance of a stay, some background of the case, and how this case fits into the larger assault on the administrative state. I also refer to this newsletter from Steve Vladeck's Substack.
Our next episode will be about the case SEC v. Jarkesy, which is the final case we will be looking at that continues the theme of the assault on the administrative state.
