What is new at the Poodle Ranch?

This episode discusses Paragraphs 12 through 15.

Paragraph 12 to gives buyer and seller a space to provide for special specific concerns.

As a Senior Property Tax Consultant, I know that the County Appraisal District may subscribe to the sales prices from property sales recorded at commercial real estate websites and residential MLS at HAR.com

We can also deal with Buyer requested repairs. Should the seller do repairs.  How does the buyer get credit or money from the seller, for buyer repairs.

We discuss Paragraph 14 which deals with rollback and recapture of property taxes if buyer should change the use of land which currently has exemptions for agriculture, cattle or timber, etc.

Last several episodes, we discussed the commercial contract paragraphs 1 through 6.  This episode we will talk about paragraphs 7 through 11.  Large snake pits herein. There is language which we can use when negotiating the contract to avoid problems after the option feasibility period of the contract.

The contract to purchase a commercial property is similar to the contract to purchase a 1 - 4 family residential property, however commercial properties are more apt to be irregular with more snakes, landmines and grass fires. The commercial contract is several more paragraphs and pages.

We discuss page one with the first 3 paragraphs.

Although the form is fill in the blank, there are challenges which depend on the uniqueness of he property. We need to be concerned with the circumstances of the buyer and the wishes of the seller. Often the wishes of the seller are diametrically opposed to the buyer. Sometimes other involved people and institutions, such as inspectors and lenders, can not oblige the time table of the seller.  This will be a good listen for you.

We love our neighborhood, however, there has been a vacant house in our neighborhood for 10 years and it flooded last year in hurricane Harvey. It has raccoons and rats. It may be unhealthy. You can complain if there is a vacant home in your area which is unhealthy.

Another neighbor violated the deed restrictions by converting the home to a multifamily apartment property by building a duplex and converting part of her home for tenant boarders.

Helped him sell a commercial property for his service related business, so he could retire. Happy seller and happy buyer.

Six months later he unretired to start again and he bought a polluted property without my help.

3 years later, he asked me to find a buyer so he can retire. I found a prospective buyer and the seller negotiated the sales price with buyer, face to face.

Recently helped a seller sell a 4 plex multifamily property. The buyer agent told the buyer that he did not need to sign the last page of the contract.  Plus, the lender wanted a closing statement which is not allowed by the State of Texas. After closing, the seller agreed to move out the next day from the furnished apartment which he occupied.  However, the buyer had a locksmith change the lock, the next morning, before the seller's moving van arrived.

My most memorable deal in 24 years resulted in me being asked by a prosecuting attorney for the State of Texas Dept of Insurance to be witness in Austin against 3 persons trying to commit fraud. The prospective buyer was part of the scam.
