Wer ein Erbe in Italien antreten muss, trifft auf ein Rechtssystem, das sich in zentralen Punkten deutlich vom deutschen Erbrecht unterscheidet.

Während der Nachlass in Deutschland mit dem Tod des Erblassers automatisch auf die Erben übergeht, verlangt das italienische Recht eine ausdrückliche oder zumindest schlüssige Annahme der Erbschaft.

ERBE AUS ITALIEN IN DEUTSCHLAND VERSTEUERN

Maßgeblich für die deutsche Erbschaftsteuerpflicht ist nicht die Staatsangehörigkeit, sondern der Wohnsitz beziehungsweise der gewöhnliche Aufenthalt der Beteiligten zum Zeitpunkt des Erbfalls. 

Nach § 2 ErbStG besteht in Deutschland die sogenannte unbeschränkte Erbschaftsteuerpflicht, wenn entweder der Erblasser oder der Erwerber im Zeitpunkt des Todes seinen Wohnsitz oder gewöhnlichen Aufenthalt in Deutschland hatte. 

In diesem Fall unterliegt der gesamte weltweite Nachlass der deutschen Erbschaftsteuer – unabhängig davon, ob sich Vermögenswerte in Deutschland, Italien oder anderswo befinden.
