A group of Nantucket Residents filed a lawsuit to prevent the facility from being built, arguing it violates the Endangered Species Act because it poses a threat of extinction to the endangered Atlantic Right whale. They also argue that the administration violated the National Environmental Policy Act in approving the environmental impact statement.
