Under California state law, the family residence or any real property owned during the marriage is usually considered to be community property (or that there is a community property interest). A common misconception is that if a quitclaim deed is signed then that property becomes separate property but usually that is not the case.

Often times the most complicated part of a divorce, aside from child custody, can be the division of assets or property. Unless there is a specific agreement by both parties, the court will divide the assets equally, or 50/50, between both parties, based on the financial valuations of the property (either agreed upon or as determined by a professional evaluator).

Child support in California is determined by “Guideline Support” which is a complex formula set by the California State Legislature. Simply put, the formula includes the percentage of time each parent spends with the child and the amount of money each parent makes.

A divorce or separation will bring on many changes in a person’s life and sometimes continuing to live in the same place may no longer be feasible. It is not uncommon for a parent to notify the other that he or she plans to move, with the children, to another state to be closer to family, to take advantage of cheaper cost of living, upon accepting a new job, etc. This can be prevented by filing divorce paperwork with the court immediately.

Once a Petition for Divorce is filed the Automatic Temporary Restraining Orders or ATROs are immediately activated. The ATROs include the restraint that neither party can leave the State of California with the children without the approval of the other parent or the consent of the court. To do so would be considered a violation of a court order and could negatively impact any future child custody orders.

Each party of a divorce action is required to file a Preliminary Declaration of Disclosure within 60 days of the Petition for Divorce being legally served. The court may not always strictly enforce the 60-day deadline, however, the divorce cannot be finalized without at least the Preliminary Declaration of Disclosure being filed by each party. A Final Declaration of Disclosure is typically filed at the end of the case but can be waived upon agreement by both parties.

The Declaration of Disclosure consists of two different legal documents - the Income and Expense Declaration and the Schedule of Assets and Debts, both of which require further documentation to be attached.
