I'm worried the judge will give custody to my abusive ex. What do you mean by your ex being abusive? What is the level of abuse we're talking about? Does the court know about the abuse? Is the child malnourished? Is the child beaten with a belt? There are different levels of abuse. Is it likely that the court will grant custody to someone abusing the child? It is unlikely that a court will grant custody to an abusive parent. Parents can put their enmity toward the other parent ahead of their child's interest. In this case, the court will give custody to you.
