Oftentimes in divorce and custody, the emphasis is on how to get evidence. You need to have documentary evidence your ex-spouse is doing something wrong. How do you do it? Can I secretly record my ex-spouse for evidence? You have to be careful about this. Different jurisdictions have different rules for how you can gather evidence. In Michigan, it is legal to record your own conversation. If you're recording your conversation with your ex-spouse, that is legal. You don't need your ex-spouse's permission to do so. This is from a legal standpoint. If you are recording your ex-spouse's conversation with a partner, this becomes illegal. For that, you need to have certain permission. It is the same thing when the federal government gets a warrant for wiretapping.  In the case of your ex-spouse, even if you're permitted, should you be recording? You should realize that recording is a form of invasion of privacy. Your ex-spouse may never talk to you again. Understand that even if it is allowed by law, there will be implications.
