You've been married for 20 years. Your husband tells you he wants a divorce and serves you divorce papers. The reason 20 years is important is not because number 20 is important. The number 20 is a symbol of a long-term marriage. There are different kinds of marriages. There's a long-term and there's a short-term marriage. There's also the intermediate term marriages. If you're married 18 months that's everybody's definition of a short-term marriage. If you had 30 years, that's definitely long-term. Six to seven years is probably your intermediate-term. 20 years most people will say it's a long-term marriage. A five-year and a twenty-year marriage in the context of property division are going to look the same. The court will divide the marital assets into half. It will be divided fairly and equitably. Equitably does not always mean half. For the most part, you will be dividing the house, the business, the cars, and the money. We will also be dividing debts. With very little exception, half goes to the wife and half goes to the husband unless you can isolate a particular debt. In a long-term marriage, the discussion of alimony will come into play. This is a discussion you won't have with a one-year marriage. Alimony will be based on certain factors.  How long were you married? The longer the marriage the stronger is the alimony case. What is the disparity of income between the parties? If there's a great disparity of income, it will be strong alimony case for more money. Is there money available for alimony? The money must be available to pay for alimony. A spouse servicing so many debt may not be able to pay alimony.
