Is the marital home, if it's in your name only, necessarily yours during the divorce? In the marriage, assets are not determined strictly by whose name that asset happens to lie. The short answer is no. It does not. It is the marital home. Both parties can stay in the marital home during the divorce. Unless there is compelling reason like violence, the court will not rule in favor of one of the spouses. After the divorce, if the house is not commingled, it goes back to the owner in the title. The court may have a different perspective on a long-term marriage. It may look at the home as a marital asset and be subject to division.
